The North Dakota legislature this past week increased the penalties with the state’s current DUI law which should make drivers think twice before drinking and driving, especially for repeat offenders.
The revamp law will now double jail time for repeat offenders and in some instances triple the fines for driving drunk.
For those drivers that have twice the legal limit, the minimum mandatory sentence is two days in jail or 10 hours of community service per day of jail time.
If an injury occurs, the minimum mandatory sentence is one year in prison or two years with a prior DUI or reckless driving. If death occurs, it’s a minimum mandatory sentence of three years in prison or 10 years with prior DUI or reckless driving.
The stricter penalties to the state DUI law comes after two serious accidents that killed two young children who were brothers at Lake Metigoshe and an entire family on I-94 this past year.
